The terms that govern your use of 1887First.com.

These Terms of Use (“Terms”) govern your access to and use of 1887First.com and related services that link to these Terms. The website is operated by 1887 First LLC, doing business as 1887 First (“1887 First,” “we,” “us,” or “our”).

By using the website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website.

Our services

1887 First operates an independent media platform and creative agency rooted in Historic Eatonville, Florida. The website may include journalism, commentary, historical material, community information, advertising, agency services, event information, merchandise, forms, newsletters, and links to third-party services.

We may modify, suspend, or discontinue features when reasonably necessary. We do not guarantee that every feature or item will remain available.

Informational and editorial content

Our reporting and other content are provided for general informational purposes. They are not legal, financial, medical, investment, or other professional advice. You should consult an appropriate professional about decisions requiring specialized advice.

News develops over time. Although we work to publish accurate information, a story may later be updated, clarified, or corrected. Review the publication date, update notes, sources, Editorial Standards, and Corrections Policy when evaluating content.

Opinions belong to the identified author unless otherwise stated and do not necessarily represent every contributor, client, partner, sponsor, or community member.

Intellectual property

Unless otherwise stated, the website and its original text, design, branding, logos, photographs, video, audio, graphics, databases, and other content are owned by or licensed to 1887 First and are protected by applicable intellectual-property laws.

You may link to our public pages and share brief excerpts for commentary, criticism, education, or discussion when you provide clear credit and a link to the original page. You may not reproduce entire articles, remove credits or notices, sell our content, train or populate a competing commercial product with our content, scrape the website at scale, or use our name, logo, images, or reporting in advertising without written permission, except as allowed by law.

  • Upload material you do not have the right to submit
  • Interfere with forms, security controls, analytics, commerce, or website operation
  • Use contact information obtained through the website for spam, harassment, or unauthorized solicitation

We may restrict access or remove submissions when reasonably necessary to protect the website, our work, other users, or the public.

Submissions and story tips

If you submit text, images, documents, recordings, ideas, feedback, or other material, you represent that you have the right to submit it and that doing so does not unlawfully violate another person's privacy, confidentiality, copyright, or other rights.

You retain ownership of material you own. You grant 1887 First a nonexclusive, worldwide, royalty-free license to store, review, copy, verify, edit, reproduce, and use the material for the purpose for which it was submitted, including evaluating and producing potential editorial coverage, responding to your request, maintaining records, and protecting legal rights. Public use or publication remains subject to editorial judgment and any separate written agreement.

Submitting material does not guarantee publication, payment, credit, return, confidentiality, anonymity, representation, employment, or a business relationship. A standard form or email does not create an attorney-client relationship, reporter-source privilege, fiduciary relationship, or contractual duty of confidentiality.

Do not send information that could place you or another person at immediate risk without first asking the editorial team whether an appropriate secure channel is available.

Editorial comments

Comments may be available on editorials. If you publish a comment, you grant 1887 First a nonexclusive, worldwide, royalty-free license to host, display, reproduce, excerpt, format, moderate, and distribute that comment in connection with the website, the editorial, moderation, and promotion of the discussion. You retain any ownership rights you otherwise hold.

You are responsible for your comments. You may not post hate speech, discriminatory or dehumanizing content, threats, harassment, doxxing, unlawful material, impersonation, scams, malicious links, unauthorized copyrighted material, or repetitive spam. You also may not attempt to evade moderation or a suspension.

1887 First may review comments before or after publication and may reject, hide, remove, preserve, or provide comments to authorities when reasonably necessary to enforce these Terms, protect safety or rights, comply with law, or maintain a useful community discussion. We may close comments on any editorial or suspend commenting privileges. Publication does not mean 1887 First endorses a comment.

Agency and advertising inquiries

Submitting a project, media-kit, or advertising inquiry does not create a client relationship or require either party to proceed. Services begin only after the parties approve a separate written agreement defining scope, price, timing, ownership, approvals, and other terms.

Estimates, examples, case studies, and website descriptions are not guarantees of a particular result. Client work remains subject to the applicable signed agreement.

Sponsored content and advertising

Advertising and sponsored content should be clearly labeled. A sponsor's presence does not necessarily imply editorial endorsement. 1887 First may accept, reject, or discontinue advertising consistent with contractual obligations, editorial standards, and applicable law.

Merchandise, orders, and third-party checkout

Official merchandise may be displayed on 1887First.com and sold through Shopify or another identified commerce provider. Prices, availability, taxes, shipping, returns, refunds, payment processing, and fulfillment may be governed by checkout disclosures and separate store policies.

The broader 1887 First Marketplace may include independent vendors responsible for their own products, descriptions, inventory, fulfillment, warranties, returns, and customer service. Review the marketplace and vendor terms applicable to your transaction.

We may correct pricing or product-description errors and cancel or limit orders when permitted by law, including in cases of suspected fraud, inventory error, or unauthorized resale.

External websites

The website may link to The Ville CDC, the 1887 First Marketplace, government records, social platforms, sources, sponsors, clients, or other third parties. A link does not mean 1887 First controls or guarantees the external site. Use third-party services under their own terms and privacy policies.

Disclaimer of warranties

To the fullest extent permitted by law, the website and its content are provided “as is” and “as available.” 1887 First disclaims warranties that are not expressly provided in a separate written agreement, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

We do not guarantee uninterrupted operation, error-free content, permanent availability, or that the website will be free from harmful components. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

Limitation of liability

To the fullest extent permitted by law, 1887 First and its owners, officers, employees, contractors, contributors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the website.

For claims arising solely from use of the free public website, our aggregate liability will not exceed the greater of the amount you paid directly to 1887 First for the specific website service giving rise to the claim during the preceding six months or $100. This limitation does not apply where prohibited by law or to obligations stated in a separate signed agreement.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless 1887 First and its owners, officers, employees, contractors, and agents from claims, losses, liabilities, and reasonable costs arising from your unlawful use of the website, violation of these Terms, or submission of material that violates another person's rights.

Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Unless applicable law requires otherwise or a separate agreement controls, legal proceedings relating to these Terms or the website will be brought in a court of competent jurisdiction located in Orange County, Florida.

Changes to these Terms

We may update these Terms by posting a revised version with a new effective date. Continued use after the revised Terms become effective means you accept them to the extent permitted by law.
